Terms of Service

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. Your account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@maig.dev if you suspect unauthorized access.

3. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Generate, distribute, or store illegal, harmful, or abusive content
• Circumvent usage limits or rate limits through technical means
• Attempt to gain unauthorized access to the Service or its underlying infrastructure
• Resell or sublicense access to the Service without our written permission
• Use the Service in a way that violates the terms of any AI provider (OpenAI, Anthropic, etc.) whose models you access through MAIG

We reserve the right to suspend or terminate accounts that violate these rules.

4. Subscriptions and billing

Paid plans are billed monthly on a recurring basis. All fees are charged in US dollars and are non-refundable except as described in our Refund Policy. We use Stripe for payment processing; by providing payment information you agree to Stripe's terms of service.

We may change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Service availability

We aim to provide a reliable service but do not guarantee 100% uptime. We may perform scheduled or emergency maintenance that temporarily interrupts access. We are not liable for any losses resulting from downtime.

6. Third-party AI providers

MAIG routes requests to third-party AI providers (OpenAI, Anthropic, and others). We are not responsible for the availability, accuracy, or output of those providers' models. Your use of AI-generated content is subject to the terms and policies of each respective provider.

7. Intellectual property

The MAIG platform, dashboard, and iOS SDK are our proprietary software. You retain ownership of any content you create using the Service. We do not claim ownership over your prompts, data, or application code.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAIG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

You may cancel your account at any time through the dashboard. We may terminate or suspend your account immediately for violations of these Terms. Upon termination, your access to the Service ends; we will retain data per our Privacy Policy.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in California.

12. Changes to these Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
